You and I are not poachers, but each of us can get fined, even without violating anything, and, as can be seen from the reviews of the previous article, everyone who encounters fisheries inspection on the river (to one degree or another) gets fined. So, our task is to at least reduce losses to a minimum. First, let's figure out what regulations regulate our hobby. This is Federal Law No. 166 of December 20, 2004. “On fishing and conservation of aquatic biological resources.” This law is too general and, by and large, doesn’t mean anything. As in all similar laws of our time, all rights to regulate fishing are given to “interested” structures: regional, local, municipal. And only Article 16, Clause 2, “Fishing is carried out in accordance with the rules governing the extraction (catch) of aquatic biological resources (fishing rules), directly concerns us,” that is, the main document is the “Rules for Amateur and Sports Fishing.” But the rights of the fishery inspector are prescribed by the same Federal Law No. 242 of July 18, 2006. “On the animal world”, art. 31 of which gives the right to fishery inspectors to carry out searches, personal searches, stops and inspections of vehicles, weapons and other tools for obtaining objects of the animal world, as well as to use physical force, special means, service weapons, self-defense weapons and hunting smooth-bore weapons used in as an official. This is described more fully in my article “Fisherman, huntsman, 2 trunks.” And, of course, the Administrative Code, where would we be without it? According to Articles 8.33 and 8.37, Part 2, for violating fishing rules, a fine of 2 to 5 thousand rubles is imposed on citizens with or without confiscation of the vessel and other instruments for extracting aquatic biological resources (05/07/2013). There is also an addition about cars, they even prescribed travel through rivers in unequipped places (that is, ford) from 2 to 5 (I don’t know what to call them, there are simply no normal words, how can there be no swearing!) Well, we’ve sorted out the basic legal acts. Don't forget that the law gives the power to set fishing rules to local authorities, so they can vary significantly from one area to another. So, you are jigging in a hole, you are not disturbing anything, the fish is biting... And suddenly from a depth of 10-15 meters you pick up an undersized zander (it does not fit into the permissible size), and its eyes popped out from decompression. Not a tenant of 100 pounds! Well, they threw him into the boat, and here, according to Murphy’s law, there is fisheries inspection. And you will spend a long time proving to the inspector that you are not a camel, and it is not a fact that you will prove it, rather the opposite. Or they took a pencil pike to the bait, but missed the bite, time passed, and it swallowed the bait out of nowhere. While they were taking out the hook, they opened up the entire mouth, again, no survivors, then everything was the same. Everyone has had such situations and will continue to have them. This is not on purpose, but it is a violation, and the penalty for it is from 2 to 5 thousand. What to do is up to you. You can throw it into the river, nothing will be lost there, either a predator will get it, or the crayfish will eat it, or you can quickly cut it up, wrap it in foil, and use it yourself in 20 minutes.

Or another moment. You are sitting on the bank, the little girls are standing, there is beauty all around, and suddenly, out of nowhere, the guys on the boat: “Hello! We are a raid group to combat poaching (as it is now called correctly). Inspector Pupkin, present your gear and catch for inspection.” Ksivu under your breath... Please note right away: according to the Code of Administrative Offenses, supervision in the field of fisheries is entrusted to the state fisheries protection authorities, and nothing more! No public or other inspectors are listed. We looked at the fish tank, it was normal, the hooks were also normal. And suddenly, under a bush about ten meters from you, one of the group finds scraps of old nets, floats or bricks, skeins of fishing line from the nets. And again you will make excuses for a long time, and again it will be difficult to make excuses, and if they cling to you, then it will be difficult to get out without losses. So, before settling in, take a good look around, remove all old criminal items and destroy them (it’s better to burn them) so as not to give unnecessary reasons to get caught on something.. If you get caught, what to do? 1. As always, start with a conversation, remember - you are not a poacher (although they don’t care, if they decide to defraud you, your arguments will help little, they will draw up a protocol anyway. Try to tactfully convince the inspector that he is wrong. And hang it on you other people's sins. If this does not help: 2. Ask the inspector to clearly indicate what exactly you violated. 3. Remember, the inspector must prove the fact of your violation, and not bring his own speculation. If, for example, the inspector latched on to the fact that you have two anchors on a wobbler on Akhtuba, and the spinning rod is standing near the tent, he must prove that he caught you when you were fishing with it. 4. Do not forget that during the inspection, according to the Code of Administrative Offenses, two witnesses must be present, and they cannot attract your comrades (as interested persons), and you can. 5. Film the entire procedure, it may come in handy. 6. You don’t need to be too clever in your explanations, write simply: I didn’t violate the fishing rules, I don’t agree with the protocol, the charges were brought on formal grounds, the inspector treats biased, passing off one's conjectures as reality. Something like that. But it’s better not to get into such situations, and to do this, study the fishing rules in the fishing region, be careful and think one step ahead, use only acceptable gear (if not, tear up your favorite wobbler, the fine will be higher), get rid of small items with any anyway, nothing will disappear in the river. And one more piece of advice - study the Administrative Code. A very entertaining read, there is an article for every step you take.
